| Administrative Guidelines |
4131 - REDUCTION IN FORCE
In accordance with the policy of the Board of Education to deal fairly with any classified employee effected by a reduction in force, the following guidelines shall be followed:
| A. | Records |
| 1. | A record shall be maintained for every district classified employee on which shall be entered - |
| a. | the member's name, | ||||
| b. | the date on which employment in each position began. |
| 2. | The certificates and endorsements of each prospective classified employee shall be submitted to the Superintendent for inspection and verification. |
| B. | Position Changes |
| 1. | Changing circumstances in the District which might warrant the abolition of position(s) shall be presented to the Superintendent with such recommendations for abolishment or revision of positions as may be necessary. | |||
| 2. | A seniority list shall be prepared. Seniority will commence with the date of last hire. | |||
| 3. | Holders of positions to be abolished or revised will be notified by order of the Board. |
| C. | Reduction in Force (Nontenured) |
| 1. | When a nontenured employee is to be terminated due to a reduction in force - |
| a. | dismissal notice will be given in accordance with the terms of the employee's contract, | ||||
| b. | notice of nonrenewal will be given in accordance with statute. |
| 2. | When a determination must be made as to whom among two (2) or more nontenured classified employees shall be dismissed for reduction in force, the classified employee shall have preference who has seniority of employment in the District, unless the position requires a license and/or endorsement. | |||
| Seniority will be determined by the number of years of continuous service in the District. | ||||
| If two (2) or more employees have the same length of service in the District, then seniority will be determined by the order of hire from the Board agenda. |
| D. | Reduction in Force (Tenured) |
| 1. | When the classified employee affected by a reduction in force is tenured, s/he may be transferred to another position provided s/he has seniority over the incumbent(s). | |||
| 2. | When there are no District positions which the tenured classified employee affected by a reduction in staff can claim by superior seniority, s/he shall be dismissed, shall receive thirty (30) days notice of such dismissal, and shall be placed on recall lists. | |||
| Seniority will be determined by the number of years of continuous service in the District. | ||||
| If two (2) or more employees have the same length of service, then seniority will be determined by the order of hire on the Board agenda. |
| E. | Recall | ||
| Laid off employees shall remain on a recall list for a period not to exceed two (2) years. | |||
| No "New" employees shall be hired until all the qualified employees on the recall list heave had the option of returning to employment. | |||
| Laid off employees will be responsible for notifying the District Treasurer of any change in address. |
