5111 - ELIGIBILITY OF RESIDENT/NONRESIDENT STUDENTS

The Board of Education establishes the following policy for determining eligibility to attend the schools of this District.

 A.The Board will educate, tuition-free, students who are legal residents of the District. Proof of residency will be required for registration in the District. Legal residency means a student is residing with his/her parents, legal guardians, or a relative resident with power of attorney over the student. A student may attend school in this District tuition free if a parent or legal guardian is a legal resident of the District, regardless of whether the parent or legal guardian has actual custody of the student. Legal residency, when living with a relative, must be based on the need for a suitable home and not for educational purposes.
  If the student resides in another school district but attends school in this District (where one (1) parent resides), it is the obligation of the parents to provide transportation for the student from the home of the nonresident, custodial parent.

 B.The District shall provide a free education to those students who are considered by Federal law to be illegal aliens or considered to be homeless by State established criteria.

 C.A student who is resident within the District by order of a juvenile or probate court or placed in the District as a ward of the State by an authorized agency shall be admitted tuition free.

 D.Any student who enrolls in the District under the District’s schools of choice program, shall be admitted tuition free.

 E.Foreign students, participating in a bona fide, foreign-exchange program and living with a resident host family, will be admitted tuition-free.

 F.Students whose parents do not reside within the District but who present evidence that they will move into the District within a short period of time may enroll in the schools of this District as tuition students for the time not in residence.

 G.Twelfth grade students who have begun their work toward graduation from the District's high school and whose parents no longer reside within the District may be permitted to complete their high school education as tuition students.

 H.A resident student, otherwise eligible to attend school in the District, may be denied admission if s/he has a record of behavior that the Superintendent believes would constitute a threat to the safety and well-being of staff and other students.

 I.A nonresident student placed with the District for educational reasons by a juvenile or probate court order shall be admitted tuition free.

 J.Students enrolled in the special education program of this District whose parents do not reside within the District may attend as tuition students. Reimbursement in such cases shall be in accordance with arrangements made in the Intermediate School District.

 K.Nonresidents may be accepted into the District's Adult Education Classes.

 L.Nonresident students may be accepted into the District's Summer School Program upon payment of the appropriate fees.

 M.A student who is the child of a person who is employed by the District, including an adopted child or legal ward.

The District will accept tuition students in the regular academic year program, subject to the following conditions:

 A.An application must be filled and signed by the appropriate administrators and approved by the Superintendent on an annual basis.

 B.A letter of release must be received from the District in which the student resides in order to be considered as a tuition student.

 C.The applicant must pay $1.00 tuition prior to the beginning of the first semester. The balance of the tuition must be paid prior to the start of the second semester. If the parent owns property in the District, the amount of school taxes paid shall apply toward the tuition due.

 D.Students with poor attendance records or who have had disciplinary problems will be considered individually.

 E.The Board has discretionary authority to accept nonresident students.

 F.School placement of the K-6 nonresident students will be the responsibility of the Superintendent of schools.

 G.An annual report of tuition students will be submitted to the Board at the regular meeting in June. The report will summarize all tuition students accepted during the school year and students released for tuition purposes to other District.

Students who have enrolled and are living in the District on or before the fourth (4th) Friday following Labor Day, and whose parents move from the School District after this date, may continue to complete the semester without the payment of tuition. They may not, however, be enrolled for any future semester except by specific approval of the Board.

The tuition rate, determined annually by the Board, shall not exceed the standards established in the School Code of 1976, as amended.

For the purposes of Membership State Aid, the District shall act in accordance with the State Aid Act of 1979, section 111, MCL 388.1511 as it relates to the charging of tuition and the student membership guarantee.

School Residency

To establish residency in the District, an adult student, not living with parent or guardian, shall provide written proof to the principal of such residency.
