4122.01 - DRUG-FREE WORKPLACE

The unlawful use, distribution, dispensation, possession and/or manufacturing of controlled substances, alcohol and any drug paraphernalia, as defined by State and Federal law, by District support staff member on District grounds, in District buildings and/or in connection with any District activity, is prohibited.

Before any candidate can be recommended for employment, s/he must participate in the District's drug-testing program and receive a negative report of the presence of Marijuana, Cocaine, Opiates, Amphetamines, and Phencyclidine (PCP) in his/her system.

Any District support staff member who violates the above policy may be subject to disciplinary action, up to and including termination of employment. In addition, the employee may be required to satisfactorily participate in a drug assistance or rehabilitation program approved by the Board of Education.

Any District support staff member who has been found guilty of violating a criminal drug statute in the work place shall notify the Superintendent within five (5) days after a conviction relating to the drug offense.

The Superintendent shall notify the appropriate Federal agency within ten (10) days after receiving notice of a workplace related drug conviction on the part of the support staff member.

The Superintendent shall develop a drug-free awareness program for District support staff member. District employees who request assistance for drug counseling and/or rehabilitation shall direct their request to the Superintendent. Annually, the Board shall allocate funds necessary to support the drug-free awareness program.

The Superintendent shall include in the District's employee in-service programs a drug-free awareness program which shall include the following information.

 A.the dangers of drug abuse in the workplace

 B.the employer's policy of maintaining a drug-free workplace

 C.available drug counseling, rehabilitation and employee assistance programs

 D.the penalties the Board may impose upon employees for drug abuse violations

In developing the in-service program, the Superintendent may utilize the services and assistance of the District's insurance carrier, county health department, local medical health center or other substance abuse agencies in the immediate area.

The District's faculty and staff shall annually be notified of this policy.
