5111 - ELIGIBILITY TO ATTEND SCHOOL AS A RESIDENT STUDENT
A school age student is eligible to attend the District’s schools as a resident if one (1) of the following criteria are established:
| A. | The student’s parent or guardian resides in the District. | ||
| B. | The student is placed in a licensed home or in a home of relatives in the District for the purpose of securing a suitable home for the student and not for an educational purpose. A relative, for residency purposes, is defined as a parent, grandparent, brother, sister, stepparent, stepsister, stepbrother, uncle, or aunt by marriage, blood, or adoption. | ||
| C. | The student is placed in a licensed home under the order or direction of a court or child placing agency. | ||
| D. | The student has attained the status of an emancipated minor or the age of majority under Michigan law and has established residency in the District. | ||
| E. | The student is a participant in a bona fide foreign exchange program and living with a host family that resides in the District. | ||
| F. | The student is considered homeless under Federal law. |
The person seeking to enroll the student maintains the burden to prove the circumstances which establish one of the above criteria. An eligible student may enroll in the District as a resident without having to apply for admission under "schools of choice", obtain a foundation grant "release", or pay tuition (except for foreign students who meet certain visa requirements).
District officials retain the right to assign the student to the appropriate schools, grades, programs, and classes.
Consistent with the Board’s legal authority to expel students from school, this right to enroll as a resident student may be abrogated by the Board of Education.
